Power of Attorney & Inheritance

POWER OF ATTORNEY AND INHERITANCE

The Embassy of Afghanistan in Ottawa issues Power of Attorney Forms (Wakaalat Nama) and Inheritance Registration Forms (Hasr-e-Waraasat) only to Afghan citizens residing in, and applying from Canada. Applications for Power of Attorney or Inheritance Registration can also be submitted at the Consulate General of Afghanistan in Toronto and the Consulate General of Afghanistan in Vancouver.

Checklist of requirements

  • Applicants MUST book an appointment online prior to coming to the Embassy. Clients with no prior appointments will not be serviced. 

    Visit In-person. The applicant(s) and ALL the witnesses MUST be present at the Embassy on the date and time of the appointment along with the application form and required documents.
    Application Form. Clients should fill the applications in Dari or Pashto carefully.
    Special attention to names, dates, figures and places are required. Forms can be downloaded from bottom of this page.
    Required Documents and witnesses. Please read the information below carefully and prepare for your appointment accordingly. The following persons and documents MUST be present in the Embassy during your appointment.
      A. Power of Attorney for Marriage Certificate:
        I). One of the spouses (husband or wife), who lives in Canada MUST visit the Embassy with:
          -A request letter outlining the purpose, date and place of marriage;
          -A copy of Tazkira or Passport;
          -Two recently taken photos (1 X 1 inches);
        II). Two witnesses (adult) with their copies of Tazkira or driver license and a recently taken two photos (1 X 1 inches);
        III). Copy of Tazkira and photograph of the Legal Representative (Wakeel) in Afghanistan.
        IV). Legal Representative (Wakeel): Copy of Tazkira or passport and photograph of the Legal Representative (Wakeel) in Afghanistan or other countries.

      B. All other Types of Power of Attorney:
        I). All the clients (Mowakeleen) with copy of either Tazkira, passport or driver license with a recently taken two photos (1 X 1 inches) attached to the appropriate box in the application form. Photos must be taken directly of the face and show both ears.
        II). Two witnesses with their copies of either passport (Canada), Tazkira or driver license and a recently taken photos (1 X 1 inches);
        III). Legal Representative (Wakeel): Copy of Tazkira or passport and 2 photographs (size (1x1) of the legal representative (wakeel), who will be in Afghanistan or other countries as needed.
        IV). In property related cases, if the property is inherited, a copy of Certificate of Inheritance, and a copy of property ownership (Sale Deed/ Qabala) or its details are needed.
    Fee: An applicant should pay a non refundable USD126 per Power of Attorney to the  Embassy Bank Account. The Embassy does NOT accept cash or cheque under any circumstances.

    The interview, conducted by the Consul, may last for one to two hours. Usually, Power of Attorney or Inheritance Registration forms are issued at the end of the interview. In some cases, the applicants will be asked to return on a specified day and time. At the request of applicants, where their re-appearance at the Embassy is not necessary, we can send their Power of Attorney/Inheritance Registration Form and documents by post in which case the applicants will be required to present a registered, self-addressed return envelope or enclose the necessary payment to cover postage cost.

PROCESSING FEES AND PAYMENT METHOD

• All consular charges are only payable in USD. Payment in any other currency will NOT be accepted.
• All payments must cover the total amount that is payable to the general, including the relevant fee, bank charge and any postal cost, if applicable. The payment must be received by the Embassy together with your application form before any assessment take place.
• Payments in cash, personal cheque and money draft are NOT accepted under any circumstances.
• The only acceptable method of the payment is direct deposit to the Embassy Bank Account. Please download payment instruction form here.
• Please attached the original Bank printed receipt along with your application.

 All applicants are, hereby, notified that they should make sure to have all required supporting documents available before depositing service fee to the Embassy’s bank account. The Embassy cannot return the service fee to the applicants, if their supporting documents are not complete, which in turn delays provision of the consular service to the applicants.
